The terms that govern your use of DeadRare.

These Terms of Use ("Terms") govern all use of deadrare.io (the "Website"), including creating, minting, listing, buying, selling, exchanging or modifying digital assets (the "Service"). The trading name of the Website is DeadRare.

By accessing or using any part of the Website you agree to be bound by these Terms and any policies published on the site. If you do not agree, do not use the Website. The Website is available only to individuals who are at least 18 years old.

DeadRare is a platform, not a broker, financial institution or creditor. The services it offers are administrative in nature only.

Privacy

Our Privacy Policy explains how we handle your personal data. By using the Service you also agree to that policy.

Your responsibilities

DeadRare is non‑custodial: you interact through your own Alephium wallet, and you are solely responsible for its security. You agree not to:

  • use the Service for money laundering or any illegal activity;
  • provide false identifying information; or
  • attempt to access the Service through unauthorised third‑party tools.

Where required by law or a competent authority, we may request additional information and may pause or cancel transactions until it is provided.

Content & intellectual property

Owning an NFT bought or made available on the Website gives you the right to hold, display, exchange and sell that NFT, but does not by itself grant commercial rights or ownership of the underlying brand, art, music or media unless expressly stated. Creators warrant that assets they mint and list are their own original creations.

Disclaimers

Except as expressly stated in writing, the Service and all assets listed on it are provided "as is" and "as available", without warranties of any kind. We do not warrant that the Service will meet your requirements or be uninterrupted, and we disclaim implied warranties of merchantability, fitness for a particular purpose, title and non‑infringement to the fullest extent permitted by law.

We are not liable for losses arising from, among other things: user error (such as forgotten passwords, mis‑authorised transactions or mistyped addresses); server failure or data loss; corrupted wallet files; unauthorised access; or third‑party attacks such as phishing. Crypto assets exist only by virtue of the ownership record on the blockchain; DeadRare does not guarantee it can effect any transfer of title.

Assumption of risk

You acknowledge that: blockchain asset prices are highly volatile and you may lose money; you are solely responsible for any taxes on your transactions; using internet‑based currency carries inherent technical risks; and the regulatory landscape is uncertain and may change. User‑generated content may include counterfeit, mislabelled or otherwise flawed assets, and we may hide collections or assets affected by such issues.

Limitation of liability

To the fullest extent permitted by law, DeadRare will not be liable for any indirect, consequential, incidental, special or punitive damages, or for lost profits, revenue, goodwill or data. Our maximum aggregate liability arising from the Service will not exceed the greater of the amount we received from the sale giving rise to the claim and the associated operational costs. Nothing in these Terms limits liability for fraud, or for death or personal injury caused by negligence.

Termination

We may suspend or terminate your access to the Service at any time, without notice and at our discretion, and will have no liability to you for doing so.

General

If any provision of these Terms is found invalid, the remainder stays in effect. The content on the Website is general information only and does not constitute legal, financial or tax advice — seek professional advice before acting. User‑generated content is not verified or endorsed by us. You must not introduce viruses or attempt to attack the Website; doing so may be a criminal offence which we will report.

Governing law

For consumers, these Terms and any dispute are governed by English law, with the courts of England and Wales having exclusive jurisdiction (residents of Scotland and Northern Ireland may also bring proceedings locally). For businesses, English law and the exclusive jurisdiction of the courts of England and Wales apply.
